Under the Employee Retirement Income Security Act (ERISA), a disabled person seeking to enforce their rights to long term disability benefits has a right to request from the court reimbursement of attorneys fees expended in pursuit of a claim. In a recent case, Standish v. Federal Express Corp. Long Term Disability Plan, the insurance company, Aetna Life Insurance Company, failed to follow federal law in the letter advising the disabled claimant they weren’t going to pay benefits. So the court ordered Aetna to properly adhere to the law and ordered the disability insurance company to reimburse Mr. Standish his attorneys fees.
